For the outlook of Torah law on the questions you asked, please see the answer above in Post #8, from Rabbi Moshe Weiner:
"Activities of acquiring such material by illegal purchases or transfers are forbidden."

Based on that, and the rest of his answer in that post, the issue I am addressing here is the propriety of how the software or CD content is obtained, versus whether or not the Torah law permits you to then have it your possession.

So the question is, if you had to purchase a piece of software when you first obtained it, in order to get it legally, and then you lost that software and the ability to re-install it, how could you then legally obtain it a second time without paying for it?

The same thing applies to the second situation that you asked about. If you had to purchase the CD when you first obtained it, in order to get it legally, how could you then legally obtain it by downloading it without paying for it?
